Time Limits

Depending on the circumstances of the sexual assault, there are some imposed time limits (i.e. a statute of limitations) after which a suspect can no longer be criminally charged. Filing a report in a timely manner allows law enforcement to collect the most useful and relevant evidence and witness statements to build a strong criminal case for the best chance of a successful prosecution. Delays in reporting hinder law enforcement's ability to respond promptly and effectively, and important evidence may be lost. Regardless of when a report is made, the Vermillion Police Department will collect any evidence, obtain witness statements, and determine if there is sufficient evidence to request charges in the matter.

The University imposes no time limits for complaints of sexual misconduct. The University will take reasonable steps to understand the facts, assess whether the suspect poses a present or ongoing risk of safety to the University community, and will take reasonable measures necessary to mitigate any safety risk.
